Building a house in Spain: documents and steps to check

Identify the site's Ayuntamiento and check the procedure for the proposed works with the designer. Do not assume a declaración responsable replaces a licencia for every building.

As a local example, Madrid City Council gathers its planning procedures here. The page links to licences, declarations and rules applicable in Madrid. It is not a universal form for Spain. Elsewhere, request the procedure and documentation from the competent local authority.

Municipality and parcel before the form

Find the relevant Ayuntamiento's Urbanismo service and prepare land identification. Ask the designer to check planning status and the intended use. Do not assume vacant land or a small building automatically allows the proposed residential use.

The Madrid page above is an official local example. For another municipality, use its authority's website and confirm the applicable procedure. Do not submit another municipality's forms without checking.

Confirm the project and application

Explain what you intend to build, how it will be used and the connections envisaged. Distinguish the main building from other works on the plot so the designer can assess the whole project.

Discuss required items, submission responsibility and communication with the authority. Keep proof of submission and requests for further information alongside the relevant design revision.

Before scheduling works

  • Has the procedure for your works been confirmed?
  • Does the team know site conditions and the current documentation?
  • Do you know what must be completed before starting?
  • Is someone responsible for communicating changes?
  • Have completion and occupation stages been clarified?

Avoid: assuming a declaración responsable is appropriate because it appears faster. Obtain classification from specialists and the authority, then follow the corresponding official documentation.

What this guide does not confirm

This is an orientation guide to prepare discussions, not an assessment of your plot or a complete submission checklist. Sources were consulted on 29 September 2026. Check official information and specific requirements before making construction decisions.

For a tiny house, explicitly describe its use, location, connections and whether it is fixed or movable. Do not infer an exemption from size, material or wheels.
